Text messaging (SMS)
We send text messages only to people who have opted in or who are our clients. We do not text cold prospects.
How we get your consent. You can agree to receive texts by checking the text-message box on our website form at www.nickdalba.com/lets-talk. The box is never checked for you, and you can submit the form without checking it. Clients may also give us consent verbally or in writing. Consent to receive texts is not a condition of buying any property or using our services.
What we text about. Replies to your inquiries, scheduling and confirming appointments and showings, property and new-construction updates you asked for, updates about your transaction, and occasional marketing messages such as market updates, new listings and event invitations.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. All of the sharing described in "How we share information" below excludes text messaging originator opt-in data and consent.
Calls
If you check the phone-call box on our form, Nickolas Dalba Real Estate may call you about your request and our real estate services, including calls made with automated technology and calls that use an artificial or AI-generated voice. Our AI assistant always says it is an AI. Consent is not a condition of any purchase or service. Tell us anytime, on the call, by phone or by email, and we will stop calling.
How we share information
We do not sell your personal information. We do not share your data with third parties for marketing purposes. We share information only as described here:
- Service providers that run our systems. We use HubSpot (customer relationship management), Aloware (calling and text messaging), Google Workspace (email and calendar), and Squarespace (our website host). These providers store and process information on our behalf only to provide their services to us. They are not permitted to use it for their own marketing.
- People involved in your transaction. When you ask us to help you buy or sell, we share what is needed to complete the transaction with others involved in it, such as the other party's agent or broker, The Gellman Team at eXp Realty, LLC when your transaction is handled there, title and closing companies, inspectors, builders, and others you ask us to work with.
- Legal requirements. We may share information when required by law, court order, or a licensing authority, or to protect our rights, our clients, or others.
None of the above includes your text messaging opt-in data or consent, which we never share with third parties.
Call recording
Calls and meetings with us may be recorded or transcribed so we can keep accurate notes and serve you better.
How we protect your information
We use reasonable administrative, technical, and physical safeguards to protect your information, and we limit access to people and providers who need it to serve you. No method of storing or sending information is completely secure, so we cannot guarantee absolute security.
How long we keep your information
We keep your information for as long as we need it for the purposes in this policy, including records we must keep under Missouri real estate license rules and other laws. When we no longer need it, we delete it or keep it in a form that no longer identifies you.
